Terms of Service

1. Agreement to Terms

By accessing or using CreativeForge ("Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this Platform.

2. Description of Service

CreativeForge is a proof-of-work portfolio and challenge platform connecting creative professionals (creators) with agencies and recruiters. The Platform enables creators to submit work to real creative challenges, build verified portfolios, and be discovered by agencies seeking talent.

3. User Accounts

• You must be at least 16 years old to use this Platform.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must provide accurate, current, and complete information during registration.
• You must notify us immediately of any unauthorized use of your account.

4. User Content

By submitting content to the Platform (including challenge submissions, portfolio projects, profile information, and community posts), you grant CreativeForge a non-exclusive, worldwide, royalty-free licence to use, display, and distribute your content solely for operating and improving the Platform.

You retain all intellectual property rights to your submitted work. You represent that you have all rights necessary to grant this licence and that your content does not infringe on any third party's rights.

5. Prohibited Conduct

You agree not to:

• Post content that is illegal, harmful, offensive, or violates third-party rights.
• Submit work that is not your own original creation without proper attribution.
• Attempt to gain unauthorized access to other users' accounts or the Platform's systems.
• Use the Platform for spam, phishing, or any fraudulent purpose.
• Harass, intimidate, or discriminate against other users.
• Interfere with or disrupt the Platform's operation.
• Scrape, crawl, or systematically extract data from the Platform without authorization.

6. Challenge Submissions and Prizes

Challenges are posted by agencies and organizations on the Platform. Prize amounts and selection criteria are set by the challenge creator and are not guaranteed by CreativeForge. Winners are selected at the agency's sole discretion.

Prize payments are processed through Stripe Connect. CreativeForge is not responsible for delays or failures attributable to Stripe or to incorrect payment details provided by the creator.

7. Intellectual Property

The Platform and its original content (excluding user-submitted content), features, and functionality are and will remain the exclusive property of CreativeForge and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

10. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.

11. Limitation of Liability

To the fullest extent permitted by applicable law, CreativeForge shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved in the appropriate jurisdiction. (Specific jurisdiction to be confirmed by legal counsel.)

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
